G36 Transfer of Sablefish Community Development Quota Compensation Quota Share

This amendment was necessary to facilitate full utilization of the allocated resources managed under the Individual Fishing Quota Program for the Pacific halibut and sablefish fixed gear fisheries in and off of Alaska. It was intended to relieve transfer restrictions on Community Development Quota compensation quota shares, thereby allowing transfers to persons that could use the resulting individual fishing quota to harvest the resource.

Amendment 21b established measures to control the amount of chinook salmon taken as bycatch in BSAI trawl fisheries.

38 Extend Inshore/Offshore Pollock and Pacific Cod Allocations

The provisions of Amendment 23 became the basis of Amendment 40. Thus, the apportionment of pollock would be allocated entirely for processing by the inshore sector. The apportionment of Pacific cod would be allocated 90% for the inshore sector, 10% for the offshore sector.

The purpose of Amendment 2 is to curtail increases in fishing capacity and provide stability for industry while the Council develops a long-term limited access system for this fishery. This action is necessary to promote the conservation and management objectives of the FMP.

35 Chum Salmon Savings Area

This amendment prohibits the use of trawl gear in a specified area of the Bering Sea during the pollock non-roe season. Regulatory amendments also are implemented that would increase 1995 observer coverage for mothership processor vessels and for some shoreside processors receiving pollock harvested in the catcher vessel operational area, and would require the mothership processor vessels and shoreside processors to obtain the capability for electronic transmission of daily observer reports. This action is necessary to reduce chum salmon bycatch amounts in the pollock fishery and is intended to promote the objectives of the FMP.

These regulations establish an individual fishing quota limited access system in fixed gear fisheries for Pacific halibut and sablefish in and off Alaska. In addition, this action implements a Western Alaska Community Development Quota program for halibut and sablefish fixed gear fisheries.

24 Pacific Cod Allocation by Gear Type and Season

This amendment established 1992 Pacific halibut bycatch limits for trawl and non-trawl gear in the BSAI. It also authorized regulatory amendments that would provide for in-season time/area closures to further reduce prohibited species bycatch rates. In addition, existing regulations are amended to revise the management and monitoring of prohibited species bycatch amounts and the vessel incentive program to reduce prohibited species bycatch rates.

G35 Sablefish Individual Fishing Quota Share Blocks

This amendment created both blocked and unblocked quota shares based on the 1994 quota. The amendment also clarified that blocked and unblocked quota share would be transferable subject to the approval of the NMFS Regional Director.

Sablefish Individual Fishing Quota Share Blocks

NOAA Fisheries issues a final rule to implement Amendment 31 to the Fishery Management Plan for the Groundfish Fishery of the Bering Sea and Aleutian Islands Area, Amendment 35 to the FMP for Groundfish of the Gulf of Alaska, and a regulatory amendment affecting the fishery for Pacific halibut in and off the State of Alaska. This action implements the Modified Block Proposal, which is necessary to prevent excessive consolidation of the halibut and sablefish fisheries. This action also clarifies the transfer process for the Individual Fishing Quota (IFQ) program.

G30 Research Plan/Observer Program (not implemented)

These amendments incorporate the provisions of the North Pacific Fisheries Research Plan into each FMP to provide a standard application of the Research Plan and associated observer coverage throughout applicable fisheries.

30 Increase Community Development Quota Allocation for Sablefish

This action is necessary to raise the sablefish community development quota allocation limit for qualified applicants from 12 percent to 33 percent. It is also necessary to clarify the evidence that may be used to verify vessel leases for the Pacific halibut and sablefish individual fishing quota program. It is intended to allow total allocation of the sablefish CDQ reserve and to provide IFQ program applicants with information about the evidence required for vessel lease verification.

G34 Increase Community Development Quota Allocation for Sablefish

This amendment corrected the plan so that it does not include a section on the Community Development Quota program. This action is necessary to raise the sablefish community development quota allocation limit for qualified applicants from 12 percent to 33 percent, and to clarify the evidence that may be used to verify vessel leases for the Pacific halibut and sablefish individual fishing quota program. It is intended to allow total allocation of the sablefish community development quota reserve and to provide individual fishing quota program applicants with information about the evidence required for vessel lease verification.

C2 Establish Norton Sound superexclusive area registration

This amendment removed existing regulations that superseded State of Alaska regulations that established Norton Sound as a superexclusive registration area in the exclusive economic zone of the BSAI. This action was necessary for effective management of the fishery having the smallest biomass and guideline harvest level in the BSAI crab fisheries.
